Terms & Conditions

PLEASE CAREFULLY READ THE FOLLOWING TERMS AND CONDITIONS:

1. I am 18 years old or older (or 16 in some instances), and I am the one to be tested. 

2. I agree to order my lab test from the website according to the instructions and to truthfully and accurately answer the information as requested. 

3. I understand that refunds are available for 30 days from my online order date provided I have not already submitted a specimen to the patient service center/laboratory.  No refunds are available after 30 days. There is a $30 cancellation fee which will be deducted from the refund. No changes to laboratory orders or laboratory requisitions can be made once the laboratory requisition/laboratory order has been prepared. 

4. I understand that the lab order expires automatically after 90 days and is no longer valid at the lab.  The order will be renewed one time if iHLTH.org is contacted within 90 days of the original order date.  If the price has increased since my order, I agree to pay the difference as well as a $30 processing fee to prepare the laboratory order/laboratory requisition.  

5. I agree that a lab test purchased through iHLTH.org does not constitute medical advice.  The lab test results are not a diagnosis, treatment or protocol for any disease or condition and it is recommended to me to discuss all results with a qualified health professional.  I also agree that the lab test results can be inaccurate through no fault of iHLTH.org or the ordering physician.  I agree that it is my responsibility to consult my own physician about my lab test results.  I understand and agree that neither iHLTH.org nor the ordering physician is my medical provider and that no patient/physician relationship exists or will exist as a result of my lab order or lab results.  I agree that my test results are provided for educational purposes only and I agree to follow-up with my own physician if I have any questions about my lab results or I do not feel well.  

6. I understand that the information on this website is for informational purposes only and is not a substitute for the care, medical advice or treatment provided by my physician.  I understand that each test has benefits, risks, limitations, false positives and negatives, and accuracy is not guaranteed.  I further understand that test results are best interpreted in the context of my overall clinical evaluation with a physician.  iHLTH.org and the ordering physician make no express or implied warranties, representations or endorsements whatsoever with regard to the services provided.  iHLTH.org and the ordering physician shall not be liable for any cost or damage arising either directly or indirectly from any transactions conducted or information conveyed on the website.  It is solely my responsibility to evaluate the accuracy, completeness and usefulness of all services and other information provided through the Service.  

7. I agree to indemnify, defend and hold harmless iHLTH.org and its officers, directors, employees, agents, licensors, suppliers, and any third party information providers to the Service, including the ordering physician, from and against all losses, expenses, damages and costs, including reasonable attorneys’ fees, resulting from any violation of this Agreement by me.  

8. I understand that this agreement shall be construed and enforced under and in accordance with the laws of the State of South Carolina.  Any lawsuit arising under this agreement shall be litigated in a South Carolina state court with jurisdiction for the County of Richland, South Carolina and the parties waive any objections they may have to jurisdiction. 

9. Permission to use this site is at the discretion of iHLTH.org and may be terminated at any time for any reason.  Any text or structure from this website is solely for the use of ordering lab tests via the website and I agree not to copy any portions of the website.  I furthermore agree not to use the website for illegal purposes.  I agree that iHLTH.org will not be liable to me or anyone else for any loss or injury caused in whole or part by procuring, compiling, interpreting, delivering or reporting information through this website.  In no event shall iHLTH.org be liable to me or anyone else for any decisions made or action(s) taken or not taken by me in reliance on such information.

10. I understand that if I am choosing to be tested for STDs (sexually transmitted diseases) or STIs (sexually transmitted infections) that I will not be tested for every possible STD/STI, but will only be tested for the ones that I have selected. I also understand that some STDs/STIs will not test positive immediately after infection, and may require retesting in 3 months, 6 months and at one year in certain situations where a latent period could be involved.  I understand that although it is rare, there are times there are false positive tests and false negative tests.  

11. I understand that Federal, State, and local public health authorities have regulations that require certain STDs/STIs/and other infectious diseases to be reported with my demographic and personal information.  The lab that performs my test(s) and the ordering physician will follow the regulations.  Additional confirmation testing may need to be ordered, which will be an additional cost depending on the confirmation test needed. 

12. I understand that my health insurer will not reimburse me for lab tests ordered through iHLTH.org.  iHLTH.org cannot legally provide me with a diagnostic code, which insurers require for reimbursement.  iHLTH.org does not offer receipts that include CPT codes.  

13. I understand that iHLTH.org will protect my privacy and the security of my personal health information as defined by the Health Insurance Portability and Accountability Act of 1996 (HIPAA).

14. I understand that every effort will be made to have my results returned to me within 1-3 business days after specimen collection at the patient service center, but at times the result may be delayed or the lab may require a return visit for repeat sample collection.

15. I understand that I will receive a copy of my lab results and it will be my responsibility to share copies of those results with anyone of my choosing, including hospital credentialing departments, my personal physician, my school, allied health program, university or college. iHLTH will not send results to anyone else, except when required by state health department regulations, on the customer’s behalf.   

16. I understand that by acceptance of these terms of service that if I do not hear about my results in 5 business days that it is MY responsibility to notify the website at info@iHLTH.org for instructions about receiving my results.  I understand that if I do not hear about my results, I can’t assume the test was negative or normal.

By accepting these “Terms of Service” for lab testing services, I hereby certify that I have read this entire document and I understand and agree to all of the terms and conditions.  I knowingly and voluntarily use this acceptance as my consent for appropriate laboratory screening and or HIV/STD testing.

I understand that I may not have my labs done at a patient service center in the following states due to their state regulations: New York, New Jersey, Rhode Island, Maryland.
